 189. Mr. Gregory Information on Tony Gregory Zoom on Tony Gregory  asked the Minister for Justice, Equality and Law Reform Information on John O'Donoghue Zoom on John O'Donoghue  the action the Garda is taking in relation to micro-lites which are not covered by road traffic legislation. [3847/02]

Minister for Justice, Equality and Law Reform (Mr. O'Donoghue): Information on John O'Donoghue Zoom on John O'Donoghue I understand that the term “micro-lite” in this instance refers to a type of motorised scooter. I am informed by the Garda authorities that these vehicles appear to come within the definition of a mechanically propelled vehicle for the purposes of road traffic legislation. I am further informed, however, that this view is disputed by a number of owners of such vehicles and the Garda is currently awaiting clarification of the legal position in relation to these vehicles.

I should also state that questions in relation to the road traffic legislation are a matter for my colleague, the Minister for the Environment and Local Government.
