 142. Mrs. O'Rourke Information on Mary O'Rourke Zoom on Mary O'Rourke  asked the Minister for Defence Information on Seán Barrett Zoom on Seán Barrett  if he will review the case of the disability pension claim for a person (details supplied) in County Westmeath in view of the fact that he is extremely and increasingly disabled. [4595/96]

Minister for Defence (Mr. Barrett): Information on Seán Barrett Zoom on Seán Barrett The person referred to by the Deputy applied in 1985 for a disability pension under the Army Pensions Acts. His application was referred to the Army Pensions Board, which is the statutory body appointed under those Acts to investigate and report on such applications. The board reported that the applicant did not satisfy the conditions for the award of a pension in that his disablements were not attributable to [825] his military service as required by the Army Pensions Acts.

The applicant's case has been reviewed on a number of occasions in the light of additional material furnished by him, but the board did not alter their original report. Consequently, the position remains that the applicant is not eligible for a disability pension under the Army Pensions Acts.
